1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "We", "Us", "Our" — Naung Sejahtera, a legal practice registered in Malaysia with chambers at No. 21, Jalan Raja Chulan, 50200 Kuala Lumpur
• "You", "User" — any person who accesses our website or engages our legal services
• "Services" — the pension legal services we provide, including Initial Pension Consultations, Correspondence & Claims management, and Representation & Formal Proceedings

• "Agreement" — the agreement formed between you and us when you instruct us to provide Services, as supplemented by these Terms
• "Engagement Letter" — the written confirmation of scope and fees issued when you instruct us on a matter

2. Acceptance of Terms

By accessing our Website or by instructing us to provide Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Website or engage our Services.

Our Services are intended for individuals aged 18 years and over. By engaging with us, you confirm that you have the legal capacity to enter into a binding agreement under Malaysian law.

3. Description of Services

Naung Sejahtera provides pension-related legal services to individuals in Malaysia. Our three service tiers are:

• Initial Pension Consultation (RM 237) — a single meeting to review your pension documents and explain your legal position
• Managing Correspondence & Claims (RM 282) — ongoing assistance preparing and managing communications with pension funds and authorities
• Representation & Formal Proceedings (RM 329) — full case preparation and representation in formal pension-related proceedings

Our Services are available to clients physically located in Malaysia. The scope of each engagement is set out in the Engagement Letter issued at the commencement of a matter.

4. Client Responsibilities

When engaging our Services, you agree to:

• Provide accurate and complete information relevant to your matter
• Promptly supply documents and records when requested
• Notify us of any changes to your circumstances that may affect the matter
• Keep any information provided to you in the course of our engagement confidential
• Not misuse our website, including by transmitting harmful or unlawful content

You agree not to use our Website or Services for any unlawful purpose or in any manner that could harm us, other users, or third parties.

5. Website Use

The information published on our Website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. No solicitor-client relationship is formed by your use of the Website alone.

We endeavour to keep the Website accurate and up to date but make no representation or warranty that the information on it is complete, current, or free from error. We reserve the right to modify or withdraw Website content at any time without notice.

7. Fees and Payment

Our service fees are as set out in section 3 above and in the Engagement Letter issued for each matter. All fees are expressed in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.

Payment is due as set out in the Engagement Letter. We accept payment by bank transfer or such other methods as agreed in writing. Where additional work is required beyond the scope of a service, this will be discussed and agreed with you before such work proceeds.

Refund Policy

Fees paid for completed consultations are non-refundable. Where work on a Correspondence & Claims or Representation matter has commenced, fees attributable to work already performed are non-refundable. We will discuss any outstanding amounts fairly if you choose to end an engagement before completion.

8. Confidentiality

We are bound by strict professional confidentiality obligations as members of the Malaysian Bar. Information you share with us in connection with a legal matter will not be disclosed to third parties without your consent, except where required by law or necessary to carry out your instructions.

9. Disclaimers

Legal outcomes are dependent on many factors outside our control. While we approach every matter with care and diligence, we make no representation and give no assurance as to the outcome of any particular matter. Nothing we say in the course of an engagement constitutes a prediction or assurance of a specific result.

Our Website is provided on an "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, our total liability to you in connection with any matter shall not exceed the fees paid by you for the specific Service giving rise to the claim.

We shall not be liable for any indirect, consequential, or special loss, including loss of income, opportunity, or data, however arising, whether in contract, tort, or otherwise.

Nothing in these Terms limits liability that cannot be limited under applicable Malaysian law, including liability for fraud or for death or personal injury caused by negligence.

11. Indemnification

You agree to indemnify and hold harmless Naung Sejahtera and its practitioners against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or from your use of the Website or Services in a manner that is unlawful or causes harm to a third party.

12. Termination of Engagement

Either party may terminate an engagement by giving written notice to the other. Where you terminate an engagement, fees for work already completed remain payable. Where we terminate an engagement, we will provide reasonable notice and ensure you are not left without the opportunity to seek alternative representation in time-sensitive matters.

Termination does not affect any rights or obligations that have accrued prior to the date of termination. Clauses relating to confidentiality, intellectual property, limitation of liability, and dispute resolution shall survive termination.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of a dispute arising from or in connection with our Services or these Terms, we will first seek to resolve the matter through direct and good-faith discussion.

If a dispute cannot be resolved informally within thirty (30) days of written notice, either party may refer the matter to mediation under the rules of the Malaysian Mediation Centre, failing which the matter shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

14. General Provisions

Entire Agreement

These Terms, together with the Engagement Letter for each matter, constitute the entire agreement between you and us and supersede any prior representations or understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable under Malaysian law, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a reorganisation of our practice on reasonable notice to you.

15. Changes to These Terms

We reserve the right to update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our Website following any changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
